Terms of Service

By accessing or using the i3Simple platform, website, or any related services, you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you may not access or use the Service.

Description of Service

i3Simple provides an AI-powered voice calling platform that enables businesses to automate inbound and outbound telephone communications through AI voice agents. The Service includes: AI-powered voice agent creation and configuration, inbound call handling and routing, outbound calling campaigns, appointment scheduling and management, lead qualification and CRM functionality, call recording and transcription, webhook and API integrations, phone number provisioning and SIP trunk connectivity, knowledge base management, and team management.

Eligibility and Account Registration

You must be at least 18 years of age to use the Service. You must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and must notify us immediately at support@i3simple.com of any unauthorized access. Each business entity may maintain one active account unless otherwise agreed in writing.

Subscription Plans and Billing

i3Simple offers Free, Starter, Growth, Professional, and Agency plans. Paid subscriptions are billed monthly or annually in advance. Call minutes are consumed at one credit per minute, rounded up. Additional credits may be purchased at any time. All payments are processed through Stripe. If payment fails we will retry within 3 and 5 days before suspending the account. We reserve the right to modify pricing with 30 days written notice.

Acceptable Use Policy

You may use the Service only for lawful business purposes. You agree not to: call individuals without required prior express consent, violate the TCPA or TSR, harass or impersonate any person, conduct fraudulent activity, attempt to compromise platform security, make calls to emergency services, or resell access without an authorized Agency plan. You are solely responsible for compliance with all applicable call recording disclosure laws.

TCPA Compliance

You are solely and entirely responsible for ensuring your use of the Service complies with the Telephone Consumer Protection Act and all related regulations, including obtaining prior express written consent for autodialed or prerecorded calls to cell phones, maintaining an internal do not call list, honoring all opt-out requests, and avoiding calls to numbers on the National DNC Registry. You agree to indemnify i3Simple for any TCPA violations resulting from your use.

Privacy and Data Handling

You retain ownership of all contact data you upload to the platform. Call recordings and transcripts are stored for the duration of your subscription plus 90 days following termination. Our complete Privacy Policy is incorporated into these Terms by reference and available at i3simple.com/privacy-policy.

Intellectual Property

The i3Simple platform, software, design, and underlying technology is owned by i3Simple and protected by intellectual property laws. You retain all rights to content you create using the platform. Agency plan subscribers may white-label the platform under their own brand for resale to clients.

Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, I3SIMPLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless i3Simple, its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

Dispute Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@i3simple.com. If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration under the American Arbitration Association. You waive any right to class action proceedings. These Terms are governed by the laws of the State of Delaware.

Term and Termination

You may cancel at any time through your account settings. We reserve the right to suspend or terminate your account for violations of these Terms. Upon termination, your data will be retained for 90 days and then permanently deleted. You may request a data export within this window.
