The Core Rule: Prior Express Written Consent
Before making any autodialed call to a cell phone, you need prior express written consent that includes: explicit agreement to receive automated calls, the specific phone number, a statement that consent is not a condition of purchase, and a signed record. Verbal consent is not sufficient. Purchased lists do not count.
The National Do Not Call Registry
Scrub your list against the DNC Registry before every campaign. Access updated data at least every 31 days. Per-call fines apply for calling registered numbers without a qualifying exemption.
Calling Time Restrictions
Federal law: 8:00 AM–9:00 PM local time of the called party. Many states are stricter. Your platform’s calling window is a helpful tool — but you remain legally responsible.
